MOH Might Tweak Existing Laws To Curb Sales Of Harmful Medical Devices On Online Shopping Platforms

The Ministry of Health (MOH) is examining proposals to make minor amendments to laws related to the sale of medical devices through e-commerce platforms, said Deputy Minister Datuk Lukanisman Awang Sauni.

He was quoted by Berita Harian saying that the decision was made after the Ministry received many suggestions from related industry players who are concerned about the sale of these harmful medical devices online.

Accordingly, the Ministry will also conduct a study on the various proposals before bringing them to Parliament.

We received many suggestions for e-commerce platforms to evaluate medical devices offered online. Therefore we also need to make some amendments in the Medical Devices Act 2012 (Act 737) based on the proposals.

Lukanisman said, that among the suggestions received was to withdraw the sale of medical devices that do not have MDA approval on the e-commerce platform.

Industry players suggest e-commerce platforms such as TikTok, Shopee and Lazada to have a mechanism to pull out all advertisements related to medical devices that do not have MDA approval from sales on the platform.
