AI-Generated Content That Violates Copyright Laws May Still Be Liable To Lawsuits, Says MyIPO

Individuals who create content using artificial intelligence (AI) applications that resemble existing intellectual properties may be liable to face legal action, according to Intellectual Property Corporation of Malaysia (MyIPO) Chairman Dr Mohd Zuhan Mohd Zain.

He was quoted by Bernama saying that intellectual property is protected under the Trademarks Act 2019, the Patents Act 1983, the Copyright Act 1987 and the Industrial Designs Act 1996.

For example, composing a song… if the lyrics are generated by AI but these lyrics are already registered under copyright by a publisher, then (such an act) is still considered infringement.

MyIPO to address SOP issues with AI

Mohd Zuhan said that MyIPO will address issues in July during the World Intellectual Property Organisation (WIPO) related to standard operating procedures (SOP) for AI use.

One of the issues that will be talked about is whether AI users can be charged or otherwise if they were found to be involved in copyright-related activities.

He also said that MyIPO will be involved in establishing the First National Artificial Intelligence Learning Centre at Universiti Teknologi Malaysia’s (UTM) AI Faculty.

In reality, those using AI need to understand the commands within that AI, so we will engage with UTM soon regarding the establishment of the AI Faculty. Insya-Allah, we will be part of them to ensure that the new elements of innovation and details made under that AI faculty later are synchronised with MyIPO.
